"intellectual property" je samo nacin da neradnici (advokati, birokrate, "inovatori" koji "izmisle" toplu vodu i posle nista ne rade na konto toga) zaradjuju, a da krajnji korisnik placa vise :)
 
Kad bi oni samo bili svesni koliko su smešni sa svojim tužakanjem. Naravno, sve to plaćaju krajnji korisnici njihovih uređaja, visokim cenama. A da se ne lažemo, i jedni i drugi kradu patente i šakom i kapom. I ta gomila besmislenih patenata... Čudi me da niko nije patentirao način držanja njihovih uređaja u ruci ili to što se napaja iz punjive baterije ili šta ja znam...
S druge strane, rekao bih da je sve to samo i isključivo marketing. Ipak je Apple zapravo Samsung inside. Mislite da bi Apple rizikovao da izgubi Samsung kao vodećeg snabdevača harvera za svoje iPod/Pad/Phone uređaje? Ili da bi Samsung rizikovao da izgubi svoju veliku mušteriju?

Samsung Electronics Co. (005930), the world’s biggest maker of mobile phones, was barred from selling its Galaxy Nexus smartphone in the U.S. by a second court ruling this week in its global patent dispute with Apple Inc. (AAPL)

The ruling by U.S. District Judge Lucy Koh in San Jose, California, follows her June 26 order blocking U.S. sales of Samsung’s Galaxy Tab 10.1 computer in the patent and trademark- infringement lawsuit over smartphones and tablets. On June 7, Koh expedited evidence sharing for Apple’s bid to block sales of Samsung’s newest Galaxy smartphone, the Galaxy S III.

“Although Samsung will necessarily be harmed by being forced to withdraw its product from the market before the merits can be determined after a full trial, the harm faced by Apple absent an injunction is greater,” Koh said in her ruling yesterday. “Apple’s interest in enforcing its patent rights is particularly strong because it has presented a strong case on the merits.”

Apple Loses Bid for Emergency Ban on HTC Phone Imports

HTC Corp. (2498) can continue to bring its newest smartphones into the U.S. while a trade agency investigates whether the phones violate an order that the Taiwanese company stop infringing an Apple Inc. (AAPL) patent.

The U.S. International Trade Commission yesterday instituted an investigation into Apple’s claim that HTC continues to infringe a patent in violation of an order issued in December. The agency denied an emergency request to have the HTC phones, including the One X and EVO 4G LTE, detained at the U.S. border. Notice was posted on the agency’s electronic docket.

HTC’s phones were held up at the border in May, delaying plans by Sprint Nextel Corp. (S) to sell the HTC EVO 4G. The phones, made in Taiwan, were allowed into the U.S. after HTC assured U.S. Customs and Border Protection that it had worked around the Apple patent.

Shares of the Taiwanese company added 0.8 percent to NT$393.50 as of 9:18 a.m. in Taipei, heading for its highest close in almost four weeks. The benchmark Taiex (TWSE) index climbed 0.3 percent.

The patent covers a system to detect telephone numbers in e-mails so, when the number on the screen is tapped, they can be stored in directories or called without dialing.

Apple Complaint

Apple filed a complaint last month, accusing HTC of making inaccurate representations to customs officials to bypass the import ban, known as an exclusion order.

“The commission finds that Apple has not demonstrated the propriety of temporary emergency action here,” the Washington- based agency wrote. “The commission will not direct Customs to detain all subject HTC products because the commission does not have the information necessary to determine whether the respondents are currently violating the commission’s limited exclusion order.”

HTC said its mobile devices and software were redesigned, and that Apple was making legal arguments regarding infringement it hadn’t made in the original case.

Apple, based in Cupertino, California, had asked that all HTC phones that run on Google Inc. (GOOG)’s Android operating system be stopped at the border.

One Series

“HTC confirmed that the notice was received, as an expected matter of process, and will vigorously defend its case,” the company said in an e-mailed statement to Bloomberg News today. Kristin Huguet, a spokeswoman for Apple, didn’t immediately return messages seeking comment.

HTC, Asia’s second-largest smartphone maker, is counting on its One series of phones to improve its share of a market that reached $312 billion last year, according to Bloomberg Industries data.

The Taoyuan, Taiwan-based company had 4.5 percent of the global smartphone market in the first quarter, down from a peak of 10.7 percent in the second quarter of 2011, as it lost to competition from Apple’s iPhone and Samsung Electronics Co. (005930)’s Galaxy line.

Ban ‘Improper’

Samsung, based in Suwon, South Korea, argued in a court filing that Koh’s order barring tablet sales is “improper” and should be lifted while the company appeals the ruling. The court relied on old evidence and has refused to consider newer evidence demonstrating that a patent at issue in the case is invalid, according to the filing.

Koh rejected that argument, writing in her order that Samsung “ has not raised a substantial question of validity” of the patent at issue.

Samsung is disappointed with the court’s decision, Nam Ki Yung, a Seoul-based spokesman said in an e-mail.

“We believe today’s ruling will ultimately reduce the availability of superior technological features to consumers in the United States,” Nam said.

Apple has previously said it isn’t a coincidence that Samsung’s latest products look like the iPhone and iPad. It has said the “blatant copying” is wrong and that it needs to protect its intellectual property. Kristin Huguet, a spokeswoman for Apple, declined to comment beyond the company’s earlier statement.

HTC’s devices don’t infringe four Apple patents for the technology and three of those patents are invalid, Judge Christopher Floyd said today.

The U.K. court judgment “marks a considerable defeat for Apple in the smartphone patent wars,” said Peter Bell, an attorney at Stevens & Bolton LLP, who isn’t involved in the case. “Two of Apple’s prize patents have been knocked out in the U.K.”

Apple is fighting patent lawsuits on four continents against rivals including HTC and South Korea-based Samsung Electronics Co. (005930) as it competes for dominance of the $219 billion global smartphone market. The firms have accused each other of copying designs and technology used in mobile devices.

“Competition is healthy, but competitors should create their own original technology, not steal ours,” Cupertino, California-based Apple said in an e-mailed statement, without commenting specifically on today’s decision.

While HTC was pleased with the ruling, “we remain disappointed that Apple continues to favor competition in the courtroom over competition in the marketplace,” Andrea Sommer, a spokeswoman for the Taoyuan City, Taiwan-based company said.

Photographs, Alphabets

In addition to the slide-to-unlock feature, today’s ruling covered Apple’s patents on tools used to scroll through photographs and change alphabets, and software allowing users to touch the screen in two spots simultaneously.

While the court ruled that Apple’s photo-management patent is valid, Floyd found that HTC didn’t infringe it.

The same four patents are being contested by Apple and HTC in German lawsuits, scheduled to be heard later this year.

In the U.S., Apple tried to stop HTC from importing its newest phones, saying they violate a patent order issued in December. The U.S. International Trade Commission decided this week that HTC could continue to import the devices while it investigated claims a system for detecting telephone numbers in e-mails was copied.

Before his death, Apple co-founder Steve Jobs waged war on Google Inc.’s Android operating system, used by HTC, Samsung and other rivals in their phones. He told his authorized biographer he would spend every penny in the company’s coffers “to destroy Android” because it was a stolen product.

Ok, ali opet ne vidim poentu u tome ko je "u pravu" u ovom patentnom ratu?
I Google i Apple hoće samo da klepe onog drugog po ušima i namaknu koje milionče pride, ništa više.
A što se tiče toga koliko šta košta, jedino mogu da kažem da uvek sve mora nešto/nekog da košta. To što na youtube-u ima nešto za free ne znači da je onaj ko kupuje pesme preko iTunes-a (ili kao ja CD-jeve u HD Audio kvalitetu) neko ko baca para, niti da onaj ko skida to radi legalno.
Da ne idem u off, za mene su i Apple i Google potpuno isti, zajedno sa ostalim mastodontima. Cilj: profit!

Apsolutno. Obe kompanije su iste, američke, i obema su na čelu jevrejske porodice. Ja Apple više volim iz samo jednog razloga. Imaju daleko bolje proizvode. Jedini Google proizvod koji je stvarno nezamenljiv je Google Search. Drugi proizvodi koji su sjajni i nikad ne bih pomislio da koristim išta drugo od konkurencije su Google Maps / Earth, GMail, Google Docs i Google Drive (mada kada je Cloud u pitanju, jednako koristim i Dropbox i iCloud, svaki za po nešto). Ipak, Android je proizvod koji je od početka, za mene (ograđujem se, naravno) - totalno dno i niko me neće ubediti u suprotno dok se jednog dana možda, sam, ne nateram da probam neki Android 5, 6 ili 7 i možda se uverim u to da je situacija drugačija. Kada je Apple u pitanju, koristim njihov telefon, iOS i iCloud. Povremeno i OS X. Zato se može reći da sam jednak "fan" Google-a kao i Apple-a - jer više Google-ovih proizvoda (u koji spadaju i usluge) dnevno koristim negoli Apple-ovih. I jednak broj Microsoftovih (kojima sam zadovoljan (Win 7, Xbox 360)). Ipak, ako govorimo o priči Android vs. iOS, naravno da je jasno šta je bolje i zbog čega. Oni koji govore suprotno - meni lično - nisu jasni.

Hajde malo pojasni sto je Android dno, ok ne nudi neke stvari out of the box kao sto to nudi iOS, ali je podlozniji customizaciji i ogromnom prilagodjavanju tvojih potreba.

Eto, za mene Android nije dno, ali mi je iOS funkcionalniji i to je to. Zašto bih ja objašnjavao i tupio ovde po forumu zašto/kako je bolji/gori kada svako ima različite afinitete prema nečemu, pa zato to i koristi, što ne povlači automatski da je ono drugo njesra koje niko ne treba da koristi.
Dakle, svakom ono što mu prija, a "konkurencija" neka isto tako uživa u veselju sa svojom igračkom.

Sto je opet poziv na Android Vs iOS prepucavanje, jer ne moze tako jednostrano da tvrdi da je jedna platforma bolja od druge i kraj price. I ovo ja ne shavatam kao njegovo iskustvo vec da misli u globalu...

Delimicno si u pravu, ali tim razmisljanjem nece niko stici ni dokle. Sada ja kazem Nokia 1100 je vrh sve ostalo je dno ne planiram da prelazim na drugo, sta mislis da li je to validna izjava? Ne znam koliko ima iskustva sa Androidom, ali ako stalno mislis da je jedna stvar vrh, a ne probas onu drugu onda su tvoje izjave krajnje subjektivne - pristrasne ;).

Apple.. totalno su propali .. samo chekam da kazu kvartalne cifre 24 jula i da stave kljuch u bravu :p

Nema podrške za http proxy, što mi zaista nije jasno. Većina corporate intraneta danas je iza proxy-a.
Nema podrške za Cisco IPSEC VPN client (ili neku kompatibilnu aplikaciju). Tu su pojedini vendori (npr. HTC) išli toliko daleko da čak izbace "tun" modul iz kernela, koji bi omogućavao tu funkcionalnost preko 3rd party aplikacija/widgeta s marketa.
