Apple lagano gubi patent bitku... not!

Hm.. onda su trebali da smisle trademark iRetina, a ne samo Retina.
Sta je Jobs mislio kada je ponovio Pikasovu recenicu, samo Jobs, zna. Sva ta tumacenja sta je u stvari hteo da kaze su PR BS. Svako kapira kako hoce.
Jos samo da neko obori MS patent na VFat pa da se resimo trolova. Bas mi je drago sto je MS izgubio u Nemackoj protiv Motorole i sada ce biti zabranjena prodaja MS proizvoda u Nemackoj (XBOX 360, Win7, ...)
 
Apple je zaštitio termin Retina kada je u kontekstu ekrana i gustine tačaka. Slično kao što je Intel uradio sa Core...

u retro sobi sam okacio vest: neko je kao argument za osporavanje VFATa patenta dao primer Atari MiNTa (multitasking OS) gde su implementirali duge nazive fajlova u FAT jedno dve godine pre Microsofta ;)

Apple explains it does this by “[dimming] the first and last sub-pixel columns of a display,” to “mitigate edge discolouration.”

dakle nema veze sa retina rezolucijom.

Ipak je u pitanju softver, a ne hardver, sto se tice ovog Retina patenta. Na sajtu patentlyapple.com pise:

Novinari k'o novinari, objave polovicnu vest, pa dovode ljude u zabunu.

Ali pazite ovo: apple je dobio pravo na patent za indikator kada je telefon upao u vodu. Rec je o traci koja se nalazi u telefonu i koja promeni boju kada se ovlazi. Evo detalja:

Samsung Electronics Co. (005930) won a legal ruling after a U.K. judge said its Galaxy tablets aren’t “cool” enough to be confused with Apple Inc. (AAPL)’s iPad.

The design for three Galaxy tablets doesn’t infringe Apple’s registered design, Judge Colin Birss said today in London in a court fight between the world’s two biggest makers of smartphones. Consumers aren’t likely to get the tablet computers mixed up, he said.

The Galaxy tablets “do not have the same understated and extreme simplicity which is possessed by the Apple design,” Birss said. “They are not as cool.”

Samsung asked the U.K. court to rule that its Galaxy tablets weren’t too similar to products created by the late Apple co-founder Steve Jobs and design chief Jonathan Ive, according to today’s judgment. Apple filed a counter-claim.

The judge found that Samsung’s products were distinctive because they were thinner and had “unusual details” on the back. He gave Apple 21 days to appeal.

II. UK Judge Rejects Design Infringement Claims
He writes, "[The Galaxy Tab line] do not have the same understated and extreme simplicity which is possessed by the Apple design... They are not as cool."

Despite the kind words, the Judge says that 50+ examples of prior art both in the industry and in fictional works show that Apple's 2004 idea was hardly "original". The Judge considered it ludicrous that Samsung be expected to differentiate the front of its device, given that extra face buttons hinder the user interface and that the hardware form factor is almost entirely constrained by the multi-touch display, an industry standard.

Judge Birss says where tablets need to differentiate themselves is in the back face and profile.
He found that "unusual details" on the back of the Samsung devices, as well as a thinner profile, made them trivially distinguishable from the iPad.

Pa to je onaj fazon..dovoljno dugo izgovorena laž, postaje istina. Ako apple jedno milion puta ponovi da ga kopira Samsung i krade mu patente, na kraju će im neko i poverovati..
 
Pa nekome ocigledno to smeta, ja ne mogu tu nista ali da kopira kopira, evo zna i moja baba. :D

The same judge who threw out Apple's injunction against Motorola has said he wonders whether patents should cover software or most any industries at all. Richard Posner, a judge who has been at it for over two decades, thinks that the constant "struggle for survival," leads tech companies into the courtroom when they should be coming up with the next innovative idea.

"As in any jungle, the animals will use all the means at their disposal, all their teeth and claws that are permitted by the ecosystem," Posner told Reuters. The judge blames the courts, not the companies, for the current patent mess we're in. Simply put, there are far too many patents needed to build a smartphone, which keeps the competition from really innovating. "You just have this proliferation of patents," Posner said. "It's a problem."

When Apple attempted to ban Motorola's phones because of an individual feature like streaming video, Posner spoke for many when he said Apple's patent "is not a claim to a monopoly of streaming video!" AKA, you can't bar an entire phone because of a single patent you have. We couldn't have said it better ourselves.

Seriously, can this guy preside over every patent trial from now on? We need a lot more of Posner's matter-of-fact logic over in Silicon Valley. While completely eliminating patents may seems ludicrous, perhaps it's the less ludicrous than the fact that Apple and Samsung have each spent tens of millions of dollars defending their innovations. Now just imagine trying to design the next great smartphone if you don't have all that cash around. It's impossible. Who knows; if it weren't for this whole circus, maybe we'd have bendable displays by now.

Ako ljudi ne vide prostu razliku u ceni i imenu... njima ne treba dati pravo glasa a kamoli pravo da se zale da li neko kopira dizajn iole :)

Ja prvo sto sam video je bilo kopiranje pakovanja :). Ali iskreno. Dok iPhone nije izasao, proizvodjaci telefona su gledali sto vece pakovanje da naprave. Samsung/HTC/Nokia telefoni su dolazi u pakovanjima velicine laptopa sa kilo prospekata i gluposti.
Posle toga su svi manje vise pravili kao apple (sto je dobro ofc :)).
Cudi me da ih Apple nije za to tuzio :p.

pa sve, kako ne vidiš, prvougaonog je oblika, display je sa prednje strane, a kamera sa zadnje, čak ima i dugmad za pojačavanje/utišavanje, i da ne nabrajam dalje... :d:d:d

Zaboravili ste da su iskopirali i mogućnost telefoniranja telefonom! To ni jedan mobilni telefon pre iPhone-a nije imao :d
 
Mene samo zanima, koliko kompanija misli unapred? Apple nece zauvek drzati trenutnu poziciju na trzistu, onda kada budu postali manji, kako ce se oni tuziti sa 15 kompanija istovremeno? Ko ne plati na mostu, platice na cupriji ;).
 
Vreme ce pokazati koliko ce biti na prvom mestu zato sto posluju sve bolje i bolje.
A i te kompanije mogu da pocnu da se tuze izmedju sebe :). Znam da nakavljujes propast jabuke vec vise od pola godine a njima sve bolje pa nebih da ti rusim sneska:)

Da, ima ovoga al' pitanje sta je tu bolje. Ranije je standardna oprema premijum telefona ukljucivala bluetooth, futrolu...negde i dock. Danas dobijes punjac sa djubre usb kablom i to je sve sto staje u kutijicu minimalistickog dizajna
 
Microsoft je nekada imao ogromnu vrednost, danas kompanija vredi par puta manje, cak su neke ogromne kompanije posle odredjenog niza godina propale, ne vidim nijedan jedini razlog zasto slicna sudbina nece stici Apple pre ili kasnije. Price Apple ce zauvek rasti ili vredeti ovoliko su price za malu decu :).

Apple granted ultimate smartphone patent

The initial idea behind the patent made sense: by filing them, inventors could prevent others from stealing and profiting from their ideas. But nowadays, it seems like companies use them more or less as legal weapons.

Well, Apple just added a nuclear missile to its arsenal. The US Patent and Trademark Office published a series of 25 newly granted Apple patents yesterday. And one of them virtually covers the entire smartphone…

PatentlyApple reports:

“Apple’s iPhone truly reinvented the smartphone and Apple’s granted patent reflects the broad range of graphical user interface innovations that they brought to market. Apple’s patent covers UI modules covering blogging, email, telephone, camera, video player, calendar, browser, widgets, search, notes, maps and more importantly, a multi-touch interface,”

The patent, known as the ’134 patent (8,223,134), was originally filed in the first quarter of 2007, and credits Apple’s Senior VP of iOS Software Scott Forstall, among others, as an inventor.

Now that Apple has been granted this patent, we fully expect to see it come up in the company’s slew of US-based patent wars. And given its scope, it seems like it could be extremely effective.

While patent litigation is a "you win some, you lose some" kind of game, there can be no doubt that Google and its partners are losing this one on the bottom line. Google's $12.5 billion acquisition of Motorola Mobility hasn't been a game-changer.

Most of the assertions that Android device makers bring against Apple are based on standard-essential patents, which has already resulted in several antitrust investigations (one in the U.S., three in the EU) and resulted in only one injunction (Mannheim again), the enforcement of which was almost immediately stopped by an appeals court. Also, a Dutch court denied an injunction even prior to looking at the technical details of the patents and later determined that Samsung is entitled to damages and FRAND royalties, which will likely amount to only a few hundred thousand dollars/euros given the court's position on Samsung's original royalty demands and the size of the Dutch market -- not even chump change for Apple.

The companies who claim that Google's Android infringes on their intellectual property are too diverse to believe in a conspiracy. And I repeat myself: apart from reactive or proactive countersuits from Android companies, Apple doesn't face much of a problem with big-company lawsuits. Does it do a better job at steering clear of infringement than Google does? Does it do a better job at working out license deals or non-aggression pacts with others in the industry? Honestly, I don't know what Apple does because they obviously don't tell the public what their dealings with other industry players are like. But whatever they do, they show that the commercial success of a platform is only one of the relevant factors. Android's IP issues are not simply a function of its market share. There must be some more fundamental problems.

As an Android user, I would like to see Google address those problems more effectively. When I look at public statements made by Google officials, it sometimes seems that the company is, at different levels, in a state of denial concerning Android's intellectual property issues. 11 months ago, Google announced its merger agreement with Motorola Mobility. By now, it becomes clearer and clearer that this acquisition is not the answer.
